The stakes in the battle for the America's Cup has im Handumdrehen komplett verändert. Die Berufungskammer des New York Supreme Court erklärte den Club Nautico Español de Vela (CNEV) zum Challenger of Record und setzte BMW Oracle wieder ab.

Das Blatt hat sich (vorerst) zu Gunsten Alinghis gewendet.
Das Urteil bedeutet für Cupholder Alinghi einen wichtigen Erfolg auf juristischem Parkett. Es fiel mit 3:2 Richterstimmen knapp aus. Der Golden Gate Yacht Club (GGYC) kann im Namen von BMW Oracle dagegen rekurrieren.
Die Berufungskammer sprach dem CNEV das Recht zu, mit Alinghi die Rahmenbedingungen für den nächsten America's Cup auszuhandeln. Den Spaniern wird eine Vorbereitungszeit von (mindestens) ten months granted.
